Terms of Service
Also called terms and conditions.
The short version
- You approve everything before it's posted, and you're responsible for what you approve.
- I work hard for results, but I can't guarantee rankings, reviews, calls, or sales. Google controls its own platform.
- Full refund if you cancel before your website goes live.
- Once your site is live, there's a 3-month minimum. Your first 3 months are non-refundable. After that, service is month-to-month and you can cancel anytime.
- After the minimum, canceling stops your next charge. You keep service through the end of the month you've paid for, then it ends.
- When service ends, your website comes down, unless you've been with me 6+ months and choose the $1,200 buyout to keep it.
- If something goes wrong, my liability is limited to what you paid me in the last 3 months.
These Terms of Service ("Terms") are an agreement between you (the "Client") and Camron McClain, an individual doing business as Camron McClain Local Websites ("I," "me"). By purchasing a service, checking the box at checkout, or using my services, you agree to these Terms.
1. Services
- Website ($300/month): design and build of your website with no setup fee, plus hosting that keeps it online, updates you request by text, email or my changes form (usually done within 1–2 business days), and a monthly check that everything works. I make all edits for you; there is no self-editing login. Your website stays online only while the Website plan (or Complete Online Presence) is active.
- Local Presence ($150/month): Google Business Profile setup and optimization, regular posts and updates, and drafted replies to customer reviews. Available on its own for businesses that already have a website.
- Complete Online Presence ($399/month): the Website plan and Local Presence together, with priority changes.
I use AI tools to help draft content. Every post, reply, and page is reviewed by me and sent to you for approval before it's published.
Add-ons you can add to a plan (prices before Texas sales tax):
- Quote request form ($35/month): a quote or booking request form on your site. Requests are emailed to you as they come in. I'm not responsible for requests lost to your email provider's spam filters or a wrong email address you gave me.
- Monthly results report ($25/month): a one-page summary of website visits and quote requests, plus Google profile views, calls, and direction requests when you have Local Presence. Numbers come from Cloudflare and Google and may not be exact.
- FAQ helper ($25/month): a help bubble that shows answers you've approved. It doesn't make up answers. You're responsible for keeping the answers you approve accurate, and I'll update them when you ask.
- Spanish version ($150 one-time; each additional language $75 one-time): a full translation of your site with a language menu that remembers each visitor's choice. Future changes are translated at no extra cost while your plan is active. Please have someone you trust review important wording, like prices and guarantees.
- Simple logo ($125 one-time): two logo options, one round of changes, and the final files. You own the final logo. Because I use AI tools to help, parts of a logo may not qualify for copyright registration. I'll check that it doesn't copy anyone else's logo, but I can't guarantee trademark availability.
- Review QR cards ($50 one-time): print-ready files for cards and stickers that link to your Google review page. Printing costs are yours. Google doesn't allow offering rewards for reviews or only asking happy customers, so the cards are meant for every customer.
Monthly add-ons renew with your plan and can be canceled anytime, with no refund for the current month. They end automatically when your plan ends.
What's not included: online stores, inventory systems, employee portals, custom apps, and connections to other platforms (like Shopify, Square, or booking software) aren't part of any plan. If you ask for something like this, I'll tell you whether I can do it and what it costs before any work starts, or let you know it's not a fit.
Referral rewards: for each business you refer that signs up and pays its first month (and isn't refunded), you get half of one month off your plan. Credits are applied to your next bill, can stack, have no cash value, and end if your plan ends.
2. Your responsibilities
- You confirm that the information you give me (business details, prices, hours, photos, claims about your services) is accurate and that you have the right to use any photos, logos, or text you provide.
- You are responsible for reviewing content before approving it. Once you approve content, you are responsible for it being accurate and lawful for your business.
- You keep ownership and control of your Google Business Profile and accounts. You grant me manager access only. I will never ask for your passwords.
- You follow Google's rules. I will not create fake reviews, pay for reviews, or offer incentives for reviews, and I may stop work if asked to.
3. Payment and billing
- Payments are processed securely by Stripe. I never see or store your full card number.
- Monthly packages renew automatically on the same date each month until canceled. After the 3-month minimum (see section 4), you can cancel anytime from the billing page or by emailing me.
- If a payment fails, Stripe will email you and retry your card for about two weeks. If payment still fails, the subscription cancels automatically and service stops.
- Prices may change with at least 30 days' written notice. Changes never apply to a month you've already paid for.
4. Refunds and disputes
- Before your site goes live: cancel for any reason and get a full refund of everything you've paid. Your site goes live when you approve it and I publish it at its public web address.
- 3-month minimum: once your site is live, your first 3 months of service (your first 3 monthly payments) are non-refundable. If you cancel during that time, you'll still be billed for the rest of the 3 months, and your site stays live through the end of month 3.
- After the 3-month minimum: no refunds, and you can cancel anytime. Canceling stops your next charge only. Example: if you're billed on the 10th and cancel on the 18th, you keep service until the next 10th, you aren't charged again, and service ends then. The rest of that month is not refunded.
- The 3-month minimum applies to the Website plan and Complete Online Presence. The Local Presence plan can be canceled anytime, with no refund for the current month.
- Refunds go back to your original payment method within 5 business days. See the Refund Policy for examples.
- Before filing a chargeback or payment dispute with your bank, you agree to contact me first at cam.localmarketing@gmail.com so I can make it right. This does not limit any rights you have with your bank or card issuer.
5. No guaranteed results
Google, Google Maps, and search results are controlled by Google, not me. I don't guarantee any specific ranking, number of reviews, star rating, website traffic, calls, or sales. I'm not responsible for changes Google makes to its platform, policies, or your listing, including suspensions or reviews Google removes.
6. Limitation of liability
To the fullest extent allowed by law: my services are provided "as is." I am not liable for indirect, incidental, or consequential damages, such as lost profits, lost business, or lost data. My total liability for any claim related to my services is limited to the amount you paid me in the 3 months before the claim. Nothing in these Terms limits liability for fraud, gross negligence, or anything that can't be limited under Texas law.
7. Indemnification
You agree to cover reasonable costs I incur from claims caused by information or materials you provided (for example, a photo you didn't have rights to or an inaccurate price you approved).
8. Ownership
- Your content is yours: your photos, logo, business info, menu, prices, and text always belong to you.
- Images: I only use photos and graphics you own or have permission to use, ones I make, or properly licensed stock images. I won't copy images from other websites or search results.
- The website design is mine: the design, template, layout, and code I create stay my property while you're a client. You get the right to use them on your website while your subscription is active, or permanently after a buyout.
- Your Google Business Profile always belongs to you.
- Your domain: your domain (web address) is registered in your name and belongs to you, even if you cancel.
- Site credit: while I build and manage your website, it includes a small line at the bottom that says "Managed by Camron McClain Digital LLC," with a link to my site for visitors who want their own website. After a buyout, you can remove it.
- Portfolio: I may show your website as an example of my past work, on my site and in emails to possible clients, including screenshots, your business name, and a link to your site. I never share private information like billing details, form answers, or messages from your customers.
9. Ending service
- You can cancel at any time, subject to the refund rules and 3-month minimum in section 4. Service continues through the end of the last month you're billed for, then stops.
- When service ends, all services stop, including your website, which is taken offline. I'll remove my manager access to your Google profile. You keep your Google profile and your content, and I'll send you your photos and text on request.
- I may end service with written notice, and will refund any month you've paid for but not received.
10. Website buyout
- If you've paid for at least 6 months of a monthly package, you can choose a one-time $1,200 buyout when you cancel.
- With a buyout, you get a permanent right to use your website's design, plus the website files, your photos and text, and simple instructions to host it yourself or with someone else.
- After a buyout, hosting, updates, and support are your responsibility. The buyout is not refundable once the files are delivered.
- You can't resell the design or template as your own product.
11. Governing law
These Terms are governed by the laws of the State of Texas. Any dispute will be handled in the courts of Tarrant County, Texas, unless we agree otherwise. Before going to court, we both agree to try to resolve it by talking first.
12. Changes to these Terms
I may update these Terms. If I make a significant change, I'll email active clients at least 30 days before it takes effect.
13. Privacy, cookies and refunds
How I handle your information is explained in my Privacy Policy. Cookies are covered in the Cookie Policy, and cancellations and refunds in the Refund Policy. They're part of these Terms.
